Terms of Service

These Terms of Service ("Terms") are a legal agreement between you (and, where applicable, the company you represent) and Metrak, governing your access to and use of metrak.ai and the Metrak web and mobile applications (the "Service"). By creating an account or using the Service, you agree to these Terms.

Metrak provides construction-contractor project management tools, including project cost control, bills of quantities, procurement, AI-assisted site reports, and finance tracking. We may add, change, or remove features at any time.

You must provide accurate information when creating an account and keep your login credentials confidential. You are responsible for all activity under your account. Company administrators are responsible for managing their team members' access and permissions.

Metrak offers a free plan and paid subscription plans with additional limits and features. Paid plans are billed in advance on a recurring basis until cancelled. You can cancel or change your plan at any time from your account settings; changes take effect at the end of the current billing period unless stated otherwise.

You agree not to: use the Service for any unlawful purpose; attempt to gain unauthorized access to the Service or other accounts; upload malicious code; or use the Service in a way that could disable, overburden, or impair it.

You retain ownership of the project data, documents, and other content you upload to the Service ("Your Content"). You grant Metrak a license to host, process, and display Your Content solely to provide and improve the Service. You are responsible for ensuring you have the rights to any content you upload.

Certain features (e.g. AI site reports, AI-suggested suppliers, AI insights) use artificial intelligence to generate content or suggestions based on data you provide. AI-generated output may contain errors and should be reviewed before you rely on it for business decisions.

The Service, including its software, design, and branding, is owned by Metrak and protected by intellectual property laws. These Terms do not grant you any rights to Metrak's trademarks or branding.

You may stop using the Service and close your account at any time. We may suspend or terminate access to the Service for accounts that violate these Terms or for non-payment, with notice where reasonably possible.

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Metrak is not liable for indirect, incidental, or consequential damages arising from your use of the Service.

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
